Consumer redress for misleading and aggressive practices

Response from Citizens Advice and Citizens Advice Scotland to the Law Commission and the Scottish Law Commission. The response supports the objective to gain straightforward private rights of redress for misleading and aggressive practices.

We strongly support the objective to gain straightforward private rights of redress for misleading and aggressive practices. We also support the proposed use of simpler language such as ‘liabilities of traders’ and ‘remedies for consumers’ in new legislation to enact these rights. In order to achieve this straightforward redress regime, we agree that, existing misrepresentation law needs to made accessible for consumers and that they can obtain redress for aggressive practices.
